Terms and conditions for shoppers

All orders are subject to our full terms and conditions of sale detailed below. Your statutory rights as a consumer are not affected. These terms and conditions apply to all purchases from designintro. Please read them carefully. We may occasionally amend these terms and conditions and changes will be posted on the designintrosite.
When you buy something from the designintro site you warrant to us that you are at least 18 years old and legally capable of entering into binding contracts and that you accept the terms and conditions described here.

Definitions
"designintro" means the organisation trading as designintro.co.uk.
"designintro.co.uk" and "designintro" are trading names of Sawitfirst ltd, registered in England and Wales number 4349695
"member" or "members" means a person or body registered with designintro.co.uk to sell goods via designintro.co.uk
"Conditions" means the terms and conditions set out in this document and any special terms and conditions agreed in writing by designintro.co.uk.
"Delivery date" means the date specified by the member when the goods are to be delivered.
"Goods" means those goods specified - that is  products sold by a member through designintro.
"Consumer, shopper or buyer" shall have the meaning ascribed in section 12 Unfair Contract Terms Act 1977 and including any person, body or organisation or representive of any body or organisation who buys or agrees to buy the goods through designintro.co.uk.
"gross sales income" means the total price paid by a consumer for goods from any designintro sales transaction but not including delivery charge
"net sales income" means the income derived from any designintro sales transaction less commission
"commission" means the charge made by designintro for enabling the sales transaction. Commission will be charged as a percentage of gross sales (excluding delivery charge) at the prevailing published rate or any alternative rate agreed between the member and designintro.
"sales transaction" means the sale of goods from a designintro member to a consumer

Making an order
All items are subject to availability - delivery is normally from stock within 7 days with a maximum of 28 days. All orders placed by you are subject to acceptance by us and we will confirm such acceptance to you by e-mail. If for any reason we are unable to accept your order, we will contact you by email, telephone or post to inform you.
 
Prices and Payment
The prices for any goods will be as quoted on designintro, except in the case of obvious errors. These prices include VAT and delivery costs, unless these are otherwise itemised. Saturday delivery is at an additional cost.
Because of circumstances beyond our control we may have to adjust the price of any item before dispatch. We will however give you the opportunity to cancel your order if we change an item's price after confirmation but before dispatch.
Title in the goods shall not pass to the Buyer until designintro has received in cash or clear funds payment in full.

The products
The nature and description of the products is as described in the designintro online catalogue. designintro reserve the right to  make any changes in the specification of the Products which do not materially affect their quality or performance.
Images, plans,photographs and specifications are presented in good faith but are for illustrative purpose only, and may not exactly match the product itself.
Any typographical or clerical or other error or  omission in any sales literature, quotation, price list acceptance of offer, invoice or other document or  information issued by designintro shall be subject to correction without any liability on the part of designintro
 
Liability and Disclaimer
We warrant that any product purchased through designintro is of satisfactory quality and fit for its intended purpose. In the event of a claim, the Buyer shall in the first instance contact designintro.
Our liability in connection with any product purchased through designintro is strictly limited to the purchase price of such product. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control. Your statutory rights are not affected.

Cancellations, refunds and returns
You may cancel your order at any point before dispatch or you may return any goods* purchased within 7 days of receipt. In the event of cancellation you must return any goods already dispatched to you in accordance with our returns procedure detailed in our customer information section.
If you decide to return your purchase please advise designintro on returns@designintro.co.uk stating whether you intend to return the goods or whether you wish to pay a collection and restocking charge as noted in the terms & conditions below.
No charge will be made for the return of items that are defective or unfit for the purpose described.
In any other circumstances any money which you have paid will be refunded in full if you return the goods yourself in saleable condition, or less a collection, restocking and packing charge (as shown below) if we are responsible for recovering goods, provided that the the member receives the goods in the same condition they were in at the time of delivery to you. 
Collection, restocking and packing charge per package as follows:
Small items (Post - eg clocks) £7.95
Medium items (Courier - larger accessories) £12.95
Large items (eg  furniture) £25.00
These costs are purely to assist in recovering our own packaging and transport costs etc - there is no surcharge.
If a designintro member does not have sufficient stock to be able to deliver the goods ordered by the Buyer within the defined timescale then any sum paid by the Buyer will be refunded and designintro will notify you at the address given by you in your order form. The refund will be made as soon as possible and, in any event, within 30 days of your order and the Seller will not be obliged to offer any compensation for disappointment suffered.
All refunds will be made according to the method of payment.
* Special orders - please note members cannot accept return of non stock items made to customers specific requirments - such as upholstered items or bespoke creations. Your statutory rights are not affected.

Damaged goods
Any claim regarding damaged or defective goods must be made on the day of receipt by contacting designintro on delivery@designintro.co.uk quoting your order number. Please ensure you check all goods carefully before signing for them. We cannot be responsible for replacing damaged goods if the courier is not advised of the damage on receipt in writing.

Delivery
Delivery of your order will be in accordance with our  delivery procedure as detailed in our customer information section as standard from stock, but in any case will be within a maximum of 21 days from the date of confirmation of your order, unless a longer period is agreed between the buyer and member.
designintro will use all reasonable endeavours to meet any date agreed for delivery but shall not be liable for any delay in delivery howsoever caused.
In the case of goods purchased by credit card, those goods can only be shipped to the credit card holders address (in order to protect you, we carry out extensive checks to ensure that your card is not being used fraudulently) and must be signed for on delivery.
Risk of damage to or loss of the goods shall pass to the Buyer upon delivery
The Buyer agrees to pay for any loss or extra cost incurred by designintro or members through the Buyers instructions or lack of instructions or through failure or delay in taking delivery.

Taking delivery - please ensure you check all goods carefully before signing for them. designintro and/or its members cannot be responsible for replacing damaged goods if the courier is not advised of the damage on receipt in writing.
Any damage must be repoprted in writing to the delivery driver on delivery and reported to designintro on the day of delivery or claims for damage cannot be accepted

Insolvency of buyer
In the event of the buyer becoming insolvent, going into liquidation, becoming subject to an administration order, making voluntary arrangments with its creditors or becomes bankrupt or gives reasonable grounds for causing designintro to apprehend that any of the events mentioned is about to occur, designintro shall be entitled to cancel the contract or suspend any further deliveries under the contract without any liability to the Buyer, and if the Products have been delivered but not paid for the Price shall become immediately due and payable that despite any previous arrangement or agreement to the contrary.

General
designintro shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to strikes, lock outs, accidents, war, fire, reduction in or unavailability of power at the designintro premises or any related manufacturing plants, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply whether related to designintro or a designintro member, and the party shall be entitled to a reasonable extension of its obligations.
 
Representations
No statement, description, warranty condition or recommendation contained in any catalogue, price list or advertisement or communication or made verbally by any of the Agents or Employees of the Seller shall be construed to enlarge, vary or override in any way thereof any of these conditions.
 
Law and jurisdiction
These terms and conditions shall be governed by English Law and any dispute, question or remedy howsoever arising determined exclusively by the English Courts.
